Terms of Service

These Terms govern the Wishy-Washy website, public quote flow, customer portal, e-gift certificates, electronic communications, and related online features. A separate service agreement governs the work performed at a property.

Important points
  • A quote visit is not a cleaning appointment, and requesting an estimate does not require a purchase.
  • The first-10-customer discount and 400-day price lock have separate eligibility rules below.
  • Recurring service creates reminders; it does not automatically book appointments or charge a payment method.
  • Cleaning appointments may carry a $15 late-cancellation fee when less than 24 hours' notice is received, subject to the service agreement.
  • Gift certificates do not expire and have no service or inactivity fees.

1. Agreement, operator, and eligibility

These Terms of Service ("Terms") are an agreement between you and August Quillen, doing business as Wishy-Washy Window Cleaning ("Wishy-Washy," "we," "us," or "our"). By accessing or using the website, creating an account, accepting these Terms, purchasing an e-gift certificate, or using a related online feature, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the affected feature.

You must be at least 18 years old and legally capable of entering an agreement, or use the site under the supervision of a parent or legal guardian who agrees on your behalf. If you act for a property owner, business, trust, association, or another person, you represent that you are authorized to provide information, arrange access, and enter the applicable transaction for that party.

The site is intended primarily for customers and properties in Whatcom County, Washington. We may decline a request outside our service area or capabilities. These Terms do not create an employment, agency, partnership, franchise, or joint-venture relationship.

2. Quote requests, estimates, and promotions

Quote visits and estimates

Selecting and submitting an available quote time reserves a visit for us to evaluate the property and requested scope. A quote visit is not a cleaning appointment. A request is successfully reserved only when the site displays confirmation; availability can change until submission is complete. There is no charge or purchase obligation for a standard estimate.

You agree to provide accurate contact, property, access, and scheduling information. A quote may be revised or withdrawn if the property, window count or condition, access, hazards, requested work, taxes, or other facts differ materially from the information available when it was prepared. A quote is valid only for the property, service, scope, price, and period stated in the quote or portal. It is not a promise that a particular appointment time will remain available.

A signed-in customer may reschedule or cancel an active quote visit in the customer portal until 45 minutes before its scheduled start. Inside that window, contact Wishy-Washy directly for assistance. A replacement visit remains subject to the live times available in the portal.

Extended 50% launch discount

The launch discount was originally limited to the first ten eligible customers and has been extended for a limited time. During the extension, it is available to eligible customers whose valid, non-duplicate quote requests are successfully submitted before the promotion ends, as determined by our server records. An eligible request must be for a property and exterior window-cleaning service we can serve and must include genuine, accurate contact and property information.

The discount is 50% off the standard quoted price for the first completed exterior window-cleaning service within the initially quoted scope at that property. We will confirm eligibility and show the applicable price in the quote. The discount is non-transferable, has no cash value, and cannot be combined with another discount unless we agree in writing. Added services, changed scope, repairs, unusual access, taxes, gratuities, and later work are not discounted unless the quote expressly says otherwise. We may reject fraudulent, automated, incomplete, duplicate, or ineligible submissions, but ending the extension will not remove a discount already confirmed in an issued quote.

400-day launch price lock

To qualify, you must book the first cleaning appointment for the quoted property within seven calendar days after we issue the quote. The price lock begins only when that first appointment is completed and fully paid. It then applies for 400 calendar days to the same property, exterior window-cleaning service, and quoted scope. The lock is non-transferable.

Added work, a different property, changed window count or property condition, repairs, taxes, unusual access or safety requirements, and work outside the original scope may be priced separately. A cancelled or unpaid appointment does not activate the lock. Appointments during the lock remain subject to availability, these Terms, and the applicable service agreement. The lock guarantees the eligible price, not a particular date or frequency.

General promotion rules

Promotions are subject to their stated terms, service area, capacity, and applicable law. Unless we say otherwise, offers are for one customer and one property, are non-transferable, are not redeemable for cash, and cannot be combined. A specific written offer controls over this general section. If an obvious typographical or technical error affects an offer, we may correct it before a service agreement is signed, and you may decline the corrected offer without charge.

3. Services, property access, and appointments

Service scope

The public site describes residential exterior window cleaning for one- and two-story homes, with basic screen cleaning included where screens are safely accessible. The confirmed quote and service agreement define the actual work at a particular property. Website descriptions and photographs are illustrative and do not expand a confirmed scope.

Unless the service agreement says otherwise, you will provide reasonable property access, secure pets, identify fragile or damaged areas, move items that obstruct safe access, disclose known hazards or restrictions, and authorize reasonable use of a functional exterior water spigot. You must have authority to grant this access. We may refuse or pause work when conditions are unsafe, unlawful, materially different from those disclosed, or likely to cause damage or poor results.

Existing conditions and results

Failed window seals, scratched or etched glass, hard-water staining, paint, construction debris, oxidation, damaged screens, hidden defects, and other pre-existing conditions may remain visible after cleaning. We will use reasonable care and remain responsible as stated in the service agreement and applicable law, but we are not responsible for a pre-existing condition, hidden defect, undisclosed hazard, or circumstance outside our reasonable control.

Scheduling, weather, and delays

A service date may be an arrival window unless a specific start time is confirmed. Weather, access, illness, equipment conditions, emergencies, prior jobs, utility restrictions, or other safety and quality concerns may require delay or rescheduling. We will make reasonable efforts to notify you. Neither party is liable for delay caused by events reasonably outside its control, but amounts already owed and rights provided by law remain due or available.

Customer rescheduling and cancellation

Unless a different written policy applies, you may reschedule or cancel a cleaning appointment in the customer portal until 24 hours before its scheduled start, provided the appointment has no billing activity. Contact us for assistance with an invoiced appointment or a change inside that window. If we receive less than 24 hours' notice, a $15 late-cancellation fee may apply. We may waive it for weather, illness, emergency, or another reasonable circumstance. No customer cancellation fee applies when we initiate the cancellation. Use the portal, call, text, or email the contact information shown in your agreement or in Section 11.

Recurring-service plans

Choosing a quarterly or semiannual plan creates a preferred cadence and booking reminders. It does not automatically schedule a cleaning, renew a fixed-term contract, or charge a payment method. You choose an available time for each visit. You may pause or cancel future reminders in the portal; doing so does not cancel an appointment already booked. A fresh quote may be required after a price lock or quote expires or when the property or scope changes.

Job photographs

The service agreement may authorize reasonable photographs for planning, quality control, documentation, safety, insurance, warranty, and dispute resolution. We will not use an identifiable customer or property photograph in advertising, social media, or a portfolio without separate written permission. You may raise a privacy or safety concern before work begins.

4. Accounts, private links, and acceptable use

Provide current and accurate account information. Keep passwords, authentication codes, private quote-claim links, gift-certificate view links, and gift codes confidential. You are responsible for activity you authorize and must promptly notify us of suspected unauthorized access. Do not share an account assigned to a technician, sales representative, or administrator. We may rely on instructions received through a valid session until notified of compromise.

You may not use the website or portal to:

  • break a law, violate another person's rights, misrepresent identity or authority, or submit information you are not authorized to provide;
  • access another customer's, employee's, contractor's, or property's private records;
  • probe, bypass, disable, overload, or interfere with authentication, access controls, rate limits, security, availability, or monitoring;
  • upload malware, harmful code, unlawful content, or a file unrelated to an authorized service or administrative purpose;
  • scrape, harvest, reverse engineer, frame, mirror, or use automated means against the site except as permitted by law or with our written approval;
  • make fraudulent payments, gift-certificate claims, promotion claims, chargebacks, or appointment requests; or
  • use customer, prospect, personnel, or service information for unauthorized solicitation, surveillance, discrimination, or personal purposes.

We may suspend or restrict access when reasonably necessary to protect a user, the business, or the service; investigate misuse; comply with law; or address an inactive or ended staff relationship. We will not use suspension to avoid honoring a valid payment, gift certificate, signed agreement, or consumer right. Provisions that by nature should continue after access ends will survive, including payment, ownership, disclaimers, liability limits, and dispute terms.

5. Electronic records, notices, and signatures

By accepting these Terms or affirmatively choosing an electronic signature, you consent to conduct that transaction electronically. Electronic records may include these Terms, the Privacy Policy, quote and appointment confirmations, service agreements, invoices, receipts, gift certificates, account notices, and other disclosures. Typing your legal name and checking the signature statement is intended as your signature with the same intent as signing by hand.

Hardware and software

To receive and retain electronic records, you need a current web browser, internet access, a device that can display web pages and PDF files, an active email address, and enough storage or access to a printer to save a copy. You should download or print important records when presented. Tell us if you cannot open a record.

Paper copies and withdrawing electronic consent

Before electronically signing a service agreement, you may request a paper copy to review and sign at the appointment. Contact us by email or phone. We do not currently charge for a reasonable paper copy. You may also withdraw consent to conduct a future transaction electronically by contacting us. Withdrawal does not affect the validity of records or signatures completed before we receive it and may delay online processing or require use of a paper process. Some portal features inherently require electronic delivery, but we will explain available alternatives.

Contact updates and copies

Keep your email address and telephone number current. A service agreement remains available in the customer portal while the account and record are maintained. You may request another electronic or paper copy using the contact information below. Washington law governs electronic transactions to the extent applicable.

6. Prices, invoices, payment, and e-gift certificates

Prices and invoices

Prices are in U.S. dollars unless stated otherwise. The quote, service agreement, or invoice identifies the amount, scope, and any due date. Added work requires approval and may change the price. Payment is due when work is completed or by the invoice due date. Contact us promptly with a question about completed work or a charge. You remain responsible for amounts properly due even if online checkout is temporarily unavailable.

Stripe checkout

Card payments are completed on Stripe's hosted checkout or invoice page. By submitting payment information to Stripe, you authorize the charge and agree to Stripe's applicable terms. Stripe and financial institutions may perform fraud checks or decline a transaction. We receive payment status and transaction records but not full card numbers or card security codes. A failed or cancelled checkout does not pay an invoice or activate a promotion that requires full payment.

E-gift certificates

  • Certificates are sold in whole-dollar amounts from $25 to $500 and may be applied to services we then offer, subject to quoting, availability, service area, safety, and confirmed scope.
  • Purchased certificates do not expire and have no service, dormancy, or inactivity fee. A balance remains available after partial redemption.
  • Certificates are not credit or debit cards and do not earn interest. They cannot be used to buy another gift certificate.
  • Sales are final except where refund, cash redemption, or another remedy is required by law. After a purchase using the certificate, a remaining balance under $5 is redeemable for cash on the bearer's demand as required by Washington law.
  • The code is bearer value. Keep it private. We may treat a person presenting a valid code as authorized to redeem it, subject to fraud and ownership review.
  • We are not required to replace a lost, stolen, misdirected, or exposed certificate except as required by law. Contact us promptly; if we can verify the record and unused balance, we may void and reissue the code in our discretion.
  • Purchasers are responsible for the accuracy of recipient information and for having authority to provide it. Delivery may be delayed by payment confirmation, filtering, or an incorrect email address.
  • Refunds, payment disputes, suspected fraud, or reversals may place a certificate under review, reduce or void unpaid value, or reverse a redemption, consistent with law.

Washington gift-certificate rights are described in chapter 19.240 RCW. If these Terms conflict with a nonwaivable gift-certificate right, that right controls.

7. Email, telephone, and SMS communications

Service and account communications

By providing contact information, you authorize us to use it to respond to your request and send nonmarketing communications reasonably connected to quotes, appointments, access, technician status, completion, contracts, invoices, payments, gift-certificate delivery, security, or account administration. You may also receive a direct personal call or text to discuss a request. Keep your information current and do not provide a number or address you are not authorized to use.

Optional appointment SMS program

After booking, you may separately opt in to automated or system-generated transactional texts from Wishy-Washy about that appointment. Messages may include reminders, technician en-route or arrival status, work completion, invoice, payment, and closely related service updates. Message frequency varies. Message and data rates may apply. Consent is optional, is not a condition of purchase, and does not authorize promotional or third-party marketing texts.

Reply STOP to opt out and HELP for help, or contact us directly. We will honor a reasonable revocation request. You may receive one final message confirming the opt-out. Email updates continue unless separately changed. Carriers are not liable for delayed or undelivered messages, and delivery is not guaranteed. If a mobile number changes ownership, the new owner should reply STOP and the former owner should notify us.

Optional updates

Hiring updates or future marketing communications, if offered, are optional. You may withdraw a request for those updates at any time. We may still send transactional, relationship, security, or legally required messages that are not marketing.

8. Your content, our content, and third-party services

Information and content you provide

You retain any ownership you have in messages, notes, documents, photographs, and other content you are authorized to provide. You grant us a nonexclusive, worldwide, royalty-free license to host, copy, transmit, display, adapt, and use that content only as reasonably necessary to operate the site, provide requested services, communicate, keep records, protect safety and security, comply with law, and enforce agreements. This license ends when the content is deleted from our systems, except for backups, legal retention, completed transaction records, and content that has been lawfully de-identified.

Do not provide content that is unlawful, harmful, infringing, deceptive, malicious, or unrelated to the requested interaction. Do not include credentials, full payment-card details, government identifiers, medical records, or another person's confidential information in an open-text field.

Wishy-Washy materials

The site's design, software, text, graphics, logos, photographs, and other materials are owned by Wishy-Washy or used with permission and are protected by applicable law. Subject to these Terms, we give you a limited, revocable, nonexclusive, nontransferable license to use the site for its intended personal or internal-business purpose. No other license or ownership right is granted.

Third-party services and links

The site interoperates with or links to services such as Amazon Web Services, Google, and Stripe. Their services may be governed by separate terms and privacy notices. We do not control third-party websites and are not responsible for their independent content, availability, or practices. A link is not an endorsement. These Terms continue to govern our own conduct and obligations.

Feedback and reviews

If you voluntarily send an idea or suggestion, you permit us to consider and use it without compensation or confidentiality unless we agree otherwise in writing. Nothing in these Terms prevents you from giving an honest review, reporting a concern, cooperating with a government agency, or exercising a right protected by law.

9. Availability, disclaimers, and limits of liability

Website availability

We may maintain, change, suspend, or discontinue a website feature. We do not promise uninterrupted or error-free access. Portal information may be delayed during maintenance or a provider outage; contact us if a time-sensitive request cannot be completed online. A technical error does not authorize access to information or value not assigned to you.

Website disclaimer

To the fullest extent permitted by law, the website and portal are provided "as is" and "as available." We disclaim implied warranties concerning the website, including merchantability, fitness for a particular purpose, and noninfringement. This website disclaimer does not eliminate an express promise in a quote, invoice, gift certificate, or signed service agreement; our duty to use reasonable care in performing services; or a warranty or consumer remedy that cannot lawfully be disclaimed.

Limit of liability

To the fullest extent permitted by law, Wishy-Washy will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of or inability to use the website or portal, including lost data, profit, opportunity, or goodwill, when those damages were not the direct and foreseeable result of our breach. For claims arising solely from the website or portal and not governed by a separate service agreement, our aggregate liability will not exceed the greater of $100 or the amount you paid us specifically to use the website during the 12 months before the event giving rise to the claim.

These exclusions and limits do not apply to payment or gift-certificate value we are obligated to honor; direct property damage caused by our failure to use reasonable care as provided in a service agreement; personal injury; fraud; gross negligence; willful misconduct; infringement; or any liability, statutory damages, or remedy that cannot be limited under applicable law. Some jurisdictions do not allow certain exclusions, so those exclusions apply only to the extent permitted there.

Your responsibility for misuse

You are responsible for direct losses and reasonable costs caused by your intentional unlawful use of the site, fraudulent transaction, unauthorized access to another person's records, or knowing violation of these Terms. This does not require a consumer to pay for our own negligence or waive a defense or right that cannot be waived by law.

10. Conflicts, disputes, governing law, and changes

Order of documents

A signed service agreement controls the property work it describes. A specific quote, invoice, promotion, or gift-certificate disclosure controls that transaction. These Terms govern the site and fill gaps that do not conflict with those more specific records. The Privacy Policy governs our handling of personal information. Nonwaivable law controls over every document.

Informal resolution

Please contact us first with a concern and describe the requested solution. We will try in good faith to resolve it. This informal step does not prevent either party from seeking urgent relief, using small-claims court, disputing an unauthorized payment through rights provided by law, reporting to a government agency, or filing a claim before a limitation period expires.

Washington law and courts

Washington law governs these Terms without regard to conflict-of-law rules. Any court proceeding that may lawfully be limited to a venue will be brought in a state or federal court with jurisdiction in or over Whatcom County, Washington. You and Wishy-Washy consent to that court's personal jurisdiction. If you are a consumer elsewhere, this section does not take away mandatory protections or a venue right that your local law does not allow you to waive. These Terms do not require arbitration and do not waive participation in a class action where such participation is otherwise permitted by law.

Severability, waiver, and assignment

If a provision is unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not assign an account or these Terms without our written consent. We may assign these Terms with a sale or reorganization of the business, provided the assignment does not reduce nonwaivable consumer or gift-certificate rights.

Changes to these Terms

We may update these Terms as the site, services, or law changes. The updated version will be posted here with a new effective date. Material changes will receive additional notice when reasonably appropriate. Changes apply prospectively. The version accepted for a completed electronic signature, purchase, or promotion continues to govern that transaction unless the parties lawfully agree otherwise.
